Compliance

 

The No Child Left Behind Act requires the New York State Education Department to monitor local programs and ensure compliance with applicable federal and State statute, regulations, and policy. Compliance is assessed by a document review, interviews with appropriate staff, and on-site visits. NYSED must conduct a compliance visit at least once during the four-year funding cycle of a partnership.

Compliance determines only that the program is operating within the minimum statutory and regulatory requirements. Programs must submit a written response for each area found to be out of compliance. In addition, programs that are not in compliance must develop and submit an action plan to address each identified area. When creating such an action plan, programs may wish to request technical assistance from other providers.
